The following terms and conditions are a legally binding contract between the customer (“you”) and Direct From Aus Pty Ltd (ACN 600 497 130) (“Akoda”) ("Akoda.com.au") which applies to any ordering, fulfilment and delivery of any goods and services from Akoda.com.au.  By using the Akoda website, you agree to use it subject to these Terms & Conditions. Akoda may amend its Terms & Conditions at any time without giving prior notice. Akoda reserves the right to, at any time: amend, update, change or remove any clause.



Terms:

"Order" means an order for any goods or services, placed on the Akoda.com.au;

“Account” means the user created by you on Akoda.com.au;

“Password” means the password needed to access your Account; 

"Website", "Us", "We", "Akoda" means Akoda.com.au;

"Product" refers to any thing that is sold through Akoda.com.au;

"Shipped" refers to the date the product was dispatched from our warehouse.



1.   Payment

1.1.  Payment of any product must be made in full before delivery.

1.2.  Unless otherwise agreed, payment must be made through any of the following platforms: eWay, PayPal and POLi.



2. Pricing & Taxes

2.1.  All prices are represented in Australian Dollars (AUD).

2.2.  In the event there is a genuine error in our price listing, under the Australian Consumer Law we reserve the right to void any sale. 

2.3.  All prices shown on our website are inclusive of GST.

 


3.   Orders & Delivery

3.1.  After you submit an order you will receive an order reference number via e-mail.

3.2.  The internet can be unstable at times and your order may not be received or may be delayed. In the event there is an error in our website we reserve the right to void any sale.

3.3.  Products will be posted within one business day of payment being cleared.

3.4.  Akoda reserves the right to cancel any order at any time before delivery and for whatever reason, including any order that it has previously accepted. 

3.5.  Shipping is only available within Australia at this moment in time.

3.6.  Pick-up is not available unless otherwise specified on our website.

3.7.  Akoda provides free shipping to customers and locations within Australia.



4a. Warranty

4a.1.  All new products purchased at Akoda come with 12 months warranty with Akoda. 

4a.2.  All used or second hand products purchased at Akoda come with 3 months warranty with Akoda. 

4a.3.  Warranty becomes void if the product has been found to be tampered with in, eg. software modifications, water damage, physical damage outside of regular use.

4a.4.  Warranty begins on the day the product is shipped.

4a.4.  All second hand mobile phones and tablets are guaranteed to not be considered "lost" or "stolen" by AMTA for the life of the phone.

4a.4.  Second hand mobile phones and tablets may contain refubished parts.



4b.  "14 Day Easy Returns"

4b.1.  All products purchased through Akoda come with our "14 Day Easy Returns" policy. 

4b.2.  This offer is for 14 days beginning on the day the order has been shipped.

4b.3.  Offer becomes void if the product has been found to be tampered with. This includes software modifications, water damage, physical damage outside of regular use.

4b.4.  Customer must send the product back within its original packaging, along with all included accessories, be in new condition suitable for resale

4b.5.  Customer must send back the product at their own cost and must comply with the directions provided by Akoda staff for returning the product.

4b.6.  In the spirit of this offer, Akoda reserves the right to revoke this offer if it deems a customer is abusing it.

4b.7.  This guarantee is separate to the warranty specified in section 4a.

4b.8.  All devices must have any locks remove prior to refund.



5. Stock Availability

5.1.  Stock levels fluctuate and there may be errors on the website regarding stock prices. When these errors occur, any promotion, order or offer available relevant to this error can be made void by us.

5.2.  All products purchased at Akoda come with a 14 Day Easy Returns policy. The 14 days begin on the day of the product(s) being received by the customer.

5.3.  Warranty becomes void if the product(s) has been found to be tampered with in, eg. software modifications, water damage, physical damage outside of regular use.



6. Account

6.1.  An account is not mandatory but recommended when making a purchase, customers that purchase without an account are still bound by these Terms & Conditions.

6.2.  Please ensure that you enter all information carefully when creating an account. By making an account, you agree that all information provided is true, accurate and complete. 

6.3.  We will not be liable for any costs occurring due to false, inaccurate or incomplete information provided by the customer.

6.4.  We will not be liable for any losses incurred due to loss, transfer to deletion of personal information stored by Akoda for the customer.
